Returns and warranties
Selleria Le Selle intends to guarantee the complete satisfaction of its Customers, offering them the possibility of returning one or more items and receiving a refund equal to the price of the returned items or their replacement.
The return must necessarily take place at the expense and under the responsibility of the Customer within and no later than 14 days from delivery and only on condition that the returned items are intact and never used.
Conditions and methods for replacements, returns and refunds of items purchased online in our e-shop
Return conditions
The items that the customer wishes to return must have the following requirements:
A) – The items to be returned must not have been used, worn, ironed, washed or treated in any way.
B) – The items must be returned in the same conditions in which they were shipped to the Customer and must be packaged and wrapped appropriately. C) – All the labels of the item, both fabric and hanging, must necessarily be intact and under no circumstances removed.
D) – The Customer who wishes to make a size change must follow the instructions given below under the heading “replacement for size change”
E) – Returns of underwear items will not be accepted.
F) – Refund, return or replacement is not possible in the case of:
• Personalized items
• Used items
• Items requested on order
• Items on sale and/or with a discount of more than 30% and items in the Outlet section
In the event of failure to comply with one of the above conditions, Le Selle reserves the right to not accept the returned goods and to send them back to the Customer at the latter's expense.
Important
- You cannot try on purchased saddles
- The saddles are not changed unless there are obvious manufacturing defects.
- New items that are used, even just once, are not exchanged.
Return procedure
Requests must be sent by email to sara.leselle@gmail.com within 14 days of receiving the goods, specifying:
– All personal data: Name, Surname, e-mail and Telephone – Order number of the products to be returned
– Products to be returned
– Reason for return
– IBAN and account holder (in case of refund request)
Once we have received and verified your request, we will contact you to provide you with instructions for making the return.
Attention: do not ship the products without first receiving our confirmation.
Once the checks have been passed by our staff, you will receive the refund on the indicated bank account within 20 days from the date of return of the items.
Shipping costs are never refundable.
SIZE CHANGE REPLACEMENT
If the size ordered is not suitable, it is possible to request the replacement of the product with one of the correct size. The costs of returning and shipping the new item are at the Customer's expense.
If the Customer decides to replace the product with a different product, the payment of any difference will be required.
The product replacement procedure for size changes follows the return procedure:
– Specify in the reason “replacement for size change” and possibly already indicate the correct size that we will replace.
– Wait for confirmation of receipt of the request from one of our operators
– Ship the item
– Pay for the new shipment – Receive the new item

RETURN WITH REFUND (RIGHT OF WITHDRAWAL)
If the customer is not satisfied with the purchase and does not wish to replace it with any other product, he/she has the possibility to exercise the RIGHT OF WITHDRAWAL within 14 days of receiving the product as provided for by the current legislation Legislative Decree no. 206 of 06/09/2005 integrated and modified by Legislative Decree no. 21/2014.
Selleria Le Selle reserves the right to retain the following expenses:
– Shipping costs of the original order, even in the case of free shipping. (Please note that the shipping costs required for any shipment are only a contribution and not the actual cost of shipping)
– Transaction fees in case of payment by Credit Card or Satispay (3% of the transaction amount)
The costs of returning the product are to be considered borne by the Customer, who must return the products via postal parcel or other trusted carrier.
The refund will be made by bank transfer within 20 days from the moment in which the goods for which you wish to exercise the right of withdrawal are returned.
SPECIAL CONDITIONS
In case of payment by bank transfer, if the payment has not been received on the account indicated in the order confirmation within 7 days of the signing of the contract, leselle.it has the right to cancel the order and withdraw from the contract.
Liability for any defects
Liability for defects according to the law applies. The assignment of rights by the customer is excluded. In addition to what is stated below, the customer cannot assert any further claims - regardless of any legal reason. For this reason, leselle.it is not liable for damages that have not been caused to the delivery item; in particular, leselle.it is not liable for lost profits or other damages to the customer's assets. If the contractual liability of leselle.it is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents. The customer is obliged to report obvious defects of the goods in writing immediately and in any case within a maximum of one week from receipt of the delivery. Subsequent notification of a defect is excluded. There is no defect of quality if the quality of the goods complies with the technical standard of digital photo development and processing. It is technically not possible to avoid color deviations between the photos and the original file and for this reason they do not represent a defect of quality. Likewise, there is no defect if a reduction in quality is caused by poor quality (e.g. “resolution” of the original files). No special quality conditions for the goods to be delivered are agreed. The above limitation of liability does not apply if the cause of the damage is attributable to intent or gross negligence or if there is personal injury. Furthermore, it does not apply if the customer asserts claims regulated by law. If leselle.it negligently violates an obligation belonging to the contract, the obligation to compensate for damage to property is limited to the applicable standard damage. After the execution of the supplementary performance within the scope of a replacement delivery, the customer is obliged to return the goods initially received to leselle.it within 14 days at the expense of leselle.it. The return of the defective goods must take place in accordance with the legal provisions. leselle.it reserves the right to assert damages in accordance with the conditions regulated by law. The limitation period amounts to 24 months from delivery.
Retention of title
The ordered goods remain the property of leselle.it until payment is completed. Before the transfer of ownership, the transfer to third parties, rental, pledge, assignment as security, transformation or other disposition or transformation is prohibited without the express approval of leselle.it.
Prohibition of charge, right of retention
The customer is not authorized to charge with his own claims against payment rights by leselle.it unless the customer's claims are established as indisputable or having legal force. The customer is not authorized to charge payment rights by leselle.it or retention rights even following a complaint for defects unless these result from the same contractual relationship.
Copyright
The customer is solely responsible for the content of the transferred files. In all work, the transferred files and images as well as in the storage of image files, the necessary copyright, trademark or other rights by the customer are assumed. In the event of infringement of such rights, the customer is obliged to indemnify leselle.it from claims by third parties. This is essentially done through the assumption of debt in the relationship with the claimant. If the customer does not agree to this assumption of debt, he indemnifies leselle.it from any claims in an internal relationship. In this case, the customer will have to support leselle.it in the defense of the claims; the costs resulting from this (legal defense, court fees, penalties, etc.) are borne by the customer.
License Assignment
The customer retains all rights to all documents that have been transferred to leselle.it by the customer or persons authorized by the customer. For the execution of the contract, the customer grants leselle.it the unlimited right in time and space to use the image files made available for the execution of the order. This also includes the saving, reproduction and processing of the image files. This also includes the right to make individual images available to third parties for the remedy of an error.
Criminal liability and right to refuse performance
The customer is responsible for the legitimacy of the content. By placing the order, the customer ensures that the content of the transferred image files does not violate criminal law, in particular with regard to the provisions of Sections 86 et seq., 184 et seq. of the German Criminal Code. Furthermore, leselle.it is not obligated to perform services that could result in a violation of the law by leselle.it. If the content of the files sent by the customer violates criminal law,
leselle.it will file a complaint. At the same time, leselle.it is entitled to refuse to offer the service by withdrawing from the contract. leselle.it is entitled, but not obliged, to verify the legitimacy or check the contents entered by the customer in his online photo album. If, according to the interpretation of leselle.it, the contents represent a violation of the law in force, leselle.it is entitled to delete the contents without prior notice. In the event of complaints or disputes by third parties regarding the customer's information, regardless of the legal reason, leselle.it will delete the contents promptly. A claim by third parties against leselle.it due to the blocking of contents due to complaints or complaints is excluded, provided that leselle.it has carried out an unjustified deletion without gross negligence or intent.
European Commission platform for Article 14 of REGULATION (EU) No 524/2013

Severability clause, competent court
Should one or more provisions of these general terms and conditions of sale become void, this shall not entail the voidability of the entire contract. The void provision shall be replaced by the relevant legally valid provision. If the customer is a merchant, a legal entity under public law or a public-private special fund, Cologne shall be the place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. This shall also apply if a customer does not have a general place of jurisdiction in his country, or has moved his place of residence or domicile abroad after the conclusion of the contract, or if they are unknown at the time of filing a complaint.
Current law
German law shall apply to the conclusion and execution of all contracts. The validity of the UN Convention on the Rights of the Child is excluded.
